Terms of Service

1. Acceptance of Terms

The ThermoBacon platform (the "Service") is operated by E&L Refrigeration Solutions, LLC, doing business as ThermoBacon. By accessing or using the Service, including the website at thermobacon.com, the web application at app.thermobacon.com, and related hardware and services, you agree to be bound by these Terms of Service between you and E&L Refrigeration Solutions, LLC. You also accept these Terms by checking the acceptance box when creating an account or when prompted in the application after these Terms are updated. If you do not agree, do not use the Service.

2. Description of Service

ThermoBacon provides a commercial refrigeration monitoring platform. The Service includes wireless BLE temperature and humidity sensors, ESP32 gateways, a cloud-based dashboard, and alert notifications via email and SMS. The Service is designed for commercial use in monitoring refrigeration equipment.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate and complete information when creating your account. You must notify us immediately of any unauthorized access to your account.

4. Organizations

The Service is organized around organizations. An organization administrator can invite users, manage roles (Admin, Manager, Viewer), and configure alert settings. Users may belong to multiple organizations. Each organization's data is isolated and accessible only to its members.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Interfere with or disrupt the Service or its servers
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Share your account credentials with unauthorized individuals

6. Alert Notifications

The Service sends alert notifications when sensor readings exceed configured thresholds. While we make reasonable efforts to deliver notifications promptly, we do not guarantee delivery timeliness or reliability of email or SMS notifications. Alert notifications are an aid to monitoring and do not replace direct equipment inspection and maintenance procedures.

7. SMS Alert Program

  • Program name: ThermoBacon SMS Alerts
  • Description: When you enable SMS notifications in your ThermoBacon account settings, you will receive text message alerts when your refrigeration sensors detect EMERGENCY-severity conditions that exceed your configured thresholds (temperature, humidity, compressor, battery, or connectivity alerts). Lower-severity alerts are delivered by email or push notification, not SMS.
  • Message frequency: Message frequency varies based on your alert activity. Messages are sent only when an EMERGENCY-severity alert is triggered for your equipment. You may receive several messages during an active emergency; on days with no emergencies you will receive none.
  • Message and data rates: Message and data rates may apply. Check with your wireless carrier for details about your text messaging plan.
  • Opt-in: You opt in to SMS alerts by enabling SMS notifications and providing your phone number in your ThermoBacon account settings at app.thermobacon.com. Your consent to receive SMS messages is not a condition of purchasing any goods or services.
  • Opt-out: You can stop receiving SMS messages at any time by replying STOP to any ThermoBacon text message, or by disabling SMS notifications in your account settings. After opting out, you will receive a one-time confirmation message.
  • Help: For help with SMS alerts, reply HELP to any ThermoBacon text message, or contact us at support@thermobacon.com.
  • Supported carriers: SMS alerts are supported on all major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

8. Hardware and Sensors

ThermoBacon hardware (sensors and gateways) is provided as part of the Service. Sensors require periodic battery replacement. Gateways require a network connection (WiFi or Ethernet) and a power source. You are responsible for the physical installation and maintenance of hardware at your premises.

9. Informational Use Only; No Compliance Guarantee

The Service provides informational monitoring data as an aid to your own operations. The Service is not a food-safety compliance system, does not constitute a HACCP plan or record-keeping system, and does not guarantee compliance with any health department, FDA, USDA, or other regulatory requirement. Sensor readings, computed averages, derived metrics, alerts, and reports are informational estimates and do not guarantee the safety, quality, or condition of any product. You remain solely responsible for your own food-safety program, regulatory compliance, required inspections and record-keeping, and all decisions regarding product safety and disposition.

Sensor readings reflect conditions only at each sensor's physical location at the time of measurement. Sensors can be relocated within a unit, removed from a unit, or placed in positions that do not represent overall equipment or product conditions. You are solely responsible for the placement, securing, and verification of sensors, and for confirming that each sensor is monitoring the equipment and location you intend.

You are solely responsible for configuring, reviewing, and maintaining your own alert settings, including which measurements are alerted on, the thresholds for each severity tier, notification channels, and snooze schedules. Features that propose alert settings, such as the threshold suggestion tools, generate suggestions from your historical data and are calibrated to reduce excessive alarms; they are aids only, are not guaranteed to detect every hazardous condition, and do not shift responsibility for your alert configuration to ThermoBacon. You should review suggested values before applying them and verify that your configured alerts meet your operational and regulatory needs.

10. Data Ownership

You retain ownership of all sensor data and configuration data associated with your organization. We claim no ownership rights over your data. You grant us a limited license to store, process, and transmit your data solely for the purpose of providing the Service.

11. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance.

12. Limitation of Liability

To the maximum extent permitted by law, ThermoBacon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of inventory, food spoilage, or equipment damage, arising from your use of the Service or failure to receive alert notifications.

To the maximum extent permitted by law, ThermoBacon's total aggregate liability for all claims arising out of or relating to the Service shall not exceed the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim (or one hundred dollars ($100) if you have paid nothing).

The Service is a monitoring aid and does not replace proper equipment maintenance, manual temperature checks, or compliance with food safety regulations. You remain responsible for maintaining your refrigeration equipment and complying with all applicable health and safety regulations.

13. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service if you violate these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases and your data may be deleted after a reasonable retention period.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date, and may also prompt you to review and accept the updated Terms in the application. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict-of-laws principles. Any disputes arising from these Terms or the Service shall be brought in the state or federal courts located in New Mexico, and you consent to the jurisdiction of those courts.
